These Terms of Use ("Terms") constitute a legal agreement between you ("User" or "you") and pvnode UG (haftungsbeschränkt) ("pvnode," "we," "us," or "our"). These Terms govern your access to and use of our website, mobile and web applications, application programming interface (API), and any data or services provided by pvnode (collectively, the "Services").
Our Services offer a wide range of data related to weather, renewable energy sources – including photovoltaic systems and storage systems – meteorological data, heat pumps, climate zones, and more. These Services are intended to provide valuable insights, such as yield data, historical data, and forecasts, to support decision-making processes in relevant fields.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services. This agreement becomes effective upon your use of any part of our Services, and by continuing, you consent to receive all communications from us regarding the use of the Services electronically.

3.1 Account Creation: To access our Services, registering a user account is required. You can register using your email address and a password. During the registration process, you are required to provide accurate and complete information and to update it as necessary. You are responsible for protecting your account credentials and are liable for all activities that occur under your account.
3.2 API Keys: The ability to use the API and the number of available API keys depend on the subscription plan you have chosen. API access is not included by default in free plans unless otherwise stated. If your plan grants API access, the keys are required to authenticate your requests. Use of the API must be in accordance with the guidelines described in our technical documentation.
3.3 Account Security: You are responsible for the general security of your account. You must notify us immediately of any unauthorized use or other security breach regarding your account or API keys.
3.4 Account Termination: We reserve the right to suspend or terminate your account at our discretion if there is a violation of these Terms, misuse of the Services, or other serious security or legal grounds.
4.1 Subscription Plans and Billing: We offer various subscription plans. The included features, access options, and usage limits (e.g., daily, monthly, or per request) depend on the plan chosen. Billing occurs in advance according to the booked interval. Payments are processed via an external payment service provider. Changes to or cancellation of your subscription can be made via your account settings.
4.2 Free Plan: We may offer a free plan that allows limited access to our Services. We reserve the right to change or discontinue the scope, usage limits, and availability of the free plan at any time and at our own discretion.
4.3 Usage Limits and Service Stability: To maintain the stability and performance of the Services for all users, we reserve the right to set technical limits (e.g., number of API calls). These limits may be adjusted as necessary to ensure smooth operation.
5.1 Authentication: If your plan includes API access, all requests must be verified using the provided keys or authentication methods. It is your responsibility to keep these credentials secure and confidential.
5.2 Rate Limits: Use of the API is subject to technical limits ("Rate Limits") to prevent overload. We reserve the right to adjust these limits to protect our infrastructure. If limits are exceeded, access may be temporarily throttled or blocked.
5.3 Fair Use Policy: We enforce a Fair Use Policy to ensure stable resource usage for all users. We monitor API usage and reserve the right to restrict access in cases of abusive or excessive behavior that impairs service quality for others.
5.4 Technical Requirements: Use of the API must comply with the technical specifications or API reference provided by us. Misuse that does not comply with technical requirements may lead to suspension of access.
5.5 Prohibited Uses: The API may not be used for illegal or malicious activities (e.g., security attacks, scraping, distribution of malware).
6.1 Ownership of Our Services: All content, data, and software provided via the Services remain our intellectual property or that of our licensors.
6.2 User Right of Use: We grant you a simple, non-transferable right to use the Services and data for your personal or internal business purposes, as long as a valid contractual relationship exists. You are not permitted to resell, rent, or offer the Services or data in their original form as your own API service to third parties, unless agreed upon in writing.
6.3 Uploaded User Data: If you upload data (e.g., measurements, files) manually or via interface to our Services ("User Data"), you retain the rights to this data.
6.4 Use of User Data by Us: By uploading, you grant us the right to store, process, and analyze this User Data. This right serves the purpose of providing the contractually agreed services, troubleshooting errors, as well as statistically evaluating, improving, and further developing our Services and algorithms. We will not sell or publish your User Data to third parties unless necessary for service provision or required by law.
7.1 Security: We implement appropriate technical and organizational measures to ensure the security of the Services and processed data. However, we cannot guarantee absolute protection against unauthorized access by third parties.
7.2 User Obligations: You are obliged to keep your access credentials (password, API keys) secret and protect them from third-party access. If you suspect that third parties have gained knowledge of your access credentials, you must inform us immediately and change the access credentials.
7.3 Storage Duration: We generally store your data only as long as necessary for the provision of the Services or as required by statutory retention obligations (e.g., tax law).
8.1 Ownership of Rights: All rights to the software, database structure, algorithms, design, trademarks, and other content of the Services belong exclusively to us or our licensors.
8.2 No Transfer: This agreement does not transfer any copyright or other property rights regarding the software to you. You only receive the limited right of use described in Section 6.
8.3 Prohibition of Reverse Engineering: It is prohibited to reverse engineer, decompile, or otherwise derive the source code of the software or parts thereof, unless mandatorily permitted by law.
9.1 Documentation: We provide technical documentation or an API reference describing the functionality of the interfaces. We endeavor to keep this up to date.
9.2 Support: Support inquiries can only be made via the email address provided on the website. We strive for timely processing but do not guarantee a successful resolution of technical problems or specific response times, unless agreed upon in a separate Service Level Agreement (SLA).
10.1 Availability: We strive to ensure the most uninterrupted usability of the Services possible. However, we cannot guarantee specific availability (uptime), unless explicitly agreed upon in an SLA.
10.2 Maintenance Work: We are entitled to temporarily restrict access to the Services for maintenance work, security updates, or functional enhancements. We endeavor to carry out such work during times of low usage.
11.1 Data Quality: The provided data (e.g., weather, PV yields) are based on models, estimates, and third-party sources. We assume no warranty for the correctness, completeness, or timeliness of this data.
11.2 Use at Your Own Risk: The use of the data and results is at your own risk. The Services do not constitute professional advice (e.g., investment advice for PV systems). Decisions based on our data should always be verified by your own checks.
12.1 Term: The contract runs for an indefinite period or for the fixed term selected during the ordering process.
12.2 Termination: Subscriptions can be canceled at any time effective at the end of the current billing period via the account settings.
12.3 Blocking for Good Cause: We are entitled to immediately block access and terminate the contract without notice if there is a serious violation of these Terms (e.g., misuse of the API, default of payment).
13.1 Unlimited Liability: We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
13.2 Limited Liability: In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal duties), the fulfillment of which is necessary for the proper execution of the contract. In this case, liability is limited to the typical, foreseeable damage.
13.3 Data Loss: For the loss of data, we are only liable up to the amount of effort that would have been required if you had performed regular and risk-appropriate data backups.
14.1 Law: The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
14.2 Jurisdiction: If the user is a merchant, a legal entity under public law, or a special fund under public law, Rosenheim is the exclusive place of jurisdiction for all disputes arising from this contract. Otherwise, the statutory places of jurisdiction apply.
We reserve the right to change these Terms at any time. Changes will be communicated to you via email or upon login. If you do not object to the changes within 4 weeks in text form, they are deemed accepted.
Should individual provisions of this contract be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by one that comes closest to the economic purpose of the invalid provision.
